Booking Terms and Conditions ("Terms"):

Please read these terms and conditions carefully before using Our Service.

 

Acknowledgment: 

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and La Casita del Turista S.R.L ("we", "us" and "our"). These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

 

By reserving a trip with our company, submitting a deposit, or signing this agreement, you acknowledge and accept all terms outlined herein, both for yourself and for all individuals included in the booking. This includes any minors under your guardianship or supervision (“Minor” or “Child”). Individually referred to as “Traveler” and collectively as “Travelers”. You authorize us to provide services for each Traveler. The terms and conditions detailed in this agreement represent the complete understanding and agreement between you, the Traveler (“you” or “your”), and La Casita del Turista regarding any and all bookings, reservations, trips, or transactions conducted with us. 

 

All travelers must be at least 18 years old to travel with us, unless explicitly stated otherwise. If a minor under 18 is allowed on a trip, they must be accompanied by an authorized adult.

Reservations and Payments:

​

Bookings may be made via email/website through an authorized travel agent. For reservations made within 30 days of arrival, full payment will be necessary. You are required to pay a non-refundable deposit of $350 for your booking to be confirmed, and the remaining balance must be paid in full no later than 60 days prior to the departure date of the trip. When a reservation is made 60 days or less in advance of the trip's departure date, the full trip cost must be paid at the time of booking and is not refundable.

 

The following are specifically excluded from the trip rates and are the sole responsibility of each Traveler: Airfare; travel insurance; costs of obtaining passports; visas; excess baggage charges; gratuity/tips; items of purely personal nature; such as drinks; laundry; Covid-related expenses (whether mandatory or voluntary) such as testing, quarantine, etc., communication (calls, faxes, emails etc.); international airport departure tax (to be paid in US dollars or acceptable foreign currencies); excursions or deviations from any trip itinerary. We will not be responsible or liable for deposits, payments, policies, or penalties for other services not included, such as airline tickets, separate hotel reservations, or other items handled by you and not through us.

 

Payment for the for Final Deposit: Should the final payment be unsuccessful, we reserve the right, in our sole discretion, to consider the unpaid amount as a violation of the agreement, cancel your reservation, and apply the cancellation penalties outlined in this agreement. Additionally, we reserve the right, at no cost to you, to transfer your spot to the next qualified passenger on the waitlist.

 

Credit/Debit Card Chargeback Policy:

 

We put in a lot of effort to satisfy our clients. You consent to refraining from filing a chargeback with your credit or debit card company, either directly or through a third party such as a travel agent, in the event that you are dissatisfied with our services for any reason. By accepting this contract, you understand that chargebacks are not a suitable means of evading our cancellation and refund policies. And that you will cooperate with us and any travel agent working on your behalf in a good faith effort to resolve your disagreement. We reserve the right to report false chargebacks to authorities, and we will vehemently contest any request for a chargeback. We will also produce this agreement as proof that you accepted our cancellation and refund policies. You undertake to compensate us for any legal fees, time, costs, and expenses incurred in refuting any chargeback that we win, as well as any damages we sustain as a result of your chargeback dispute.

Cancellation Policies:

All cancellation must be received in writing by email at info@lacasitadelturista.com. Your notice of cancellation will only be effective when it is received in writing by us. Any cancellations by you will result in the loss of your deposit and other monies paid to us for your trip, which are all non-refundable. No exceptions to this refund policy will be made. For this reason, we strongly recommend you have comprehensive travel insurance that includes trip cancellation/interruption coverage to help protect your financial investment in the trip.

 

If you decide to cancel your trip, the following fees apply and are due when we receive notice of your cancellation:

 

• +61 days prior to arrival date, a non-refundable deposit of USD $350 per person.

• 60 to 41 days 50% of the cost trip.

• 40 to 30 days 75% of trip cost.

• Less than 29 days 100% of the trip cost.

 

Penalties for suppliers not addressed above will also be applicable. From the time the reservation is confirmed, all of these supplier penalties are applicable. This also holds true for last-minute bookings.

If you fail to pay the remaining balance of your trip 30 days or more prior to the departure date, your booking will be considered as cancelled by you. You will forfeit your entire deposit and any money that was collected from you.

 

Form of Payment: All payments must be made by credit card. Prices are in US dollars, and all payments must be made in US dollars.

 

Trip Planning Fee: All trip prices include a non-refundable $350.00 Trip Planning Fee per person. Any refunds that we provide to you for any reason will be less than the Trip Planning Fee and any other non-recoverable costs, including any monies that we have advanced to our suppliers. 

 

Unused services: Refunds will not be issued for services that remain unused, early departures, late arrivals, or any missed days within your itinerary, regardless of the circumstances. Once the tour has begun, no refunds will be provided. If you decide not to participate in the tour due to government warnings, travel advisories, or personal apprehensions, this will be considered as a cancellation. The same conditions apply in the event that you miss the scheduled departure date of the trip, fail to participate in an activity, or are required to withdraw from the trip. Our cancellation and refund policy is strictly enforced, with no exceptions made for circumstances such as adverse weather, civil unrest, personal or family emergencies, medical issues, or any other situations beyond our control. We will not be held liable for any refunds or compensations for loss, damage, or injury, nor for any other claims if you contract an illness, disease, or sickness during your tour, or if a third party declines to provide services (such as accommodation or transportation) due to your exhibiting symptoms or testing positive for an infectious disease. Therefore, we strongly advise that you consider obtaining trip cancellation and interruption insurance.

 

Changes by You Prior to Trip Departure: It is in our sole discretion whether to accept a change request. A change fee may be applied. Our outside suppliers, including hotels, often impose additional fees or penalties for changes and cancellations. Substantial change requests by you, such as for example a change of tour dates, will result in recalculation of your original tour price. Change requests must be made in writing.

​Cancellations or Changes by Us and Flexibility: 

 

​We maintain the authority to cancel, modify, or alter any trip without prior notification for any reason, including but not limited to ensuring the safety and comfort of our clients, as well as circumstances classified as Force Majeure, as defined in this agreement. This encompasses the right to replace or substitute guides and accommodations listed in the trip materials, adjust the sequence of destinations to be visited, reschedule, postpone, or delay your trip, and implement other modifications to the itinerary. You acknowledge that amenities, accommodations, transportation, routes, schedules, and itineraries may be subject to change without prior notice due to local conditions or events, which may include mechanical failures, flight cancellations, illness, strikes, political unrest, weather conditions, border crossing issues, and other unpredictable factors. Should we need to make a significant alteration prior to departure due to a supplier issue (e.g., bankruptcy), we will notify you of available alternatives as soon as reasonably feasible.

Denial of Participation:

Force Majeure: 

We shall not be considered in violation of this agreement or held liable to you for any delays in performance or failure to fulfill its obligations under this agreement, provided that such delays or failures are attributable to circumstances classified as Force Majeure. "Force Majeure" encompasses any events beyond our reasonable control, including but not limited to natural disasters, acts of terrorism, civil unrest, explosions, floods, severe weather, typhoons, fires, accidents, warfare (both declared and undeclared), sabotage, civil disturbances, labor strikes, requisitions, illnesses, quarantines, pandemics, epidemics, and both known and unknown diseases and viruses, such as coronavirus/Covid-19 (including any subsequent spread), as well as foodborne, airborne, and communicable diseases. It also includes any form of government intervention that impacts domestic and/or international travel, government-imposed restrictions or advisories, warnings from diplomatic or health organizations (e.g., World Health Organization), border closures, adverse weather conditions, and other unforeseen events.

In the rare event that Force Majeure obstructs, significantly impedes, or renders it impossible for us or our suppliers to deliver the services, including but not limited to your tour, we and/or our suppliers reserve the right, at our sole discretion, to undertake one or more of the following actions: cancel, modify, alter, postpone, or reschedule any aspect of the tour itinerary or arrangements, including the tour dates and the entire tour itself. You acknowledge and accept that we will not be liable to compensate you for any costs, expenses, or losses incurred as a result of Force Majeure. We regret to inform you that no refunds will be issued if we implement any of the aforementioned measures due to Force Majeure, unless we are able to secure refunds from our suppliers.

Any refund provided under this section will be reduced by our non-refundable trip planning fee of $350.00 per person. It is important to understand that we are not required to pursue refunds from suppliers, and in many cases, obtaining refunds from them is not feasible once we have submitted deposits for your tour. This policy is predicated on the understanding that suppliers are not obligated to return non-refundable deposits or waive their cancellation fees in instances of Force Majeure. For this reason, we highly recommend that you secure travel insurance. Should you decide to cancel your tour in the event we invoke Force Majeure, our standard cancellation penalties (as outlined in the preceding section titled “Cancellation By You and Unused Services”) will be applicable unless we explicitly indicate otherwise.

Health and Medical: You are strongly recommended to take out personal travel insurance for all members of your party. Some suppliers require that you do so. It is your responsibility to ensure that the insurance you purchase is adequate and appropriate for your needs. 

 

Arrangement of travel insurance coverage is highly recommended for trip cancellation, loss of baggage, deposit, personal accident, injury, illness etc. Under no circumstances, shall the Company be constructed as a carrier under a contract of carriage of a passenger and of his/her baggage and other personal belongings.

If you have a physical condition, dietary limitations, or any other pre-existing medical issues that necessitate special consideration during your journey, it is imperative that you notify us in writing at the time of booking. We may request a medical certificate confirming your fitness for travel to the specified destination(s) and/or your ability to engage in all components of your travel itinerary.

Should you receive any medical care or health screenings while on the trip, We will not be held liable for the provision of such services. You will be entirely responsible for all expenses related to medical care and any associated transportation that may be required during the trip.

 

We maintain a strict policy against the use of drugs in any form during our excursions and advocates for responsible consumption of alcohol. This policy is established to ensure the safety of all participants. We retains the authority to exclude individuals from activities or the continuation of any trip itinerary, at their own expense, should they engage in the illegal use of drugs, alcohol, or other prohibited substances during the journey. While we encourage you to enjoy the local culture, the safety of our travelers remains our foremost concern.

(Travel Advisories & Warnings)

Cultural Differences and Drug Policy: Traveling to international destinations offers a wealth of diverse situations and unique experiences that differ significantly from what you may be accustomed to in your home country. These differences not only enrich your journey, but they also add an element of adventure and discovery. You will encounter a variety of cultural and social aspects unique to the region you are visiting, which may include variations in sanitation standards, food and drink practices, attire, and local laws. We, along with your guide or host, will provide insights and discuss these differences during your trip to help you navigate and appreciate them fully. However, it is equally important for you to take personal responsibility by conducting your own research and behaving responsibly while traveling.


We has a strict no-tolerance policy regarding drug use during our trips and strongly advocates for responsible alcohol consumption. This policy is not only in place to ensure the safety and well-being of all travelers but also to respect local customs and laws. We want you to thoroughly enjoy your trip and immerse yourself in the local culture, but we stress that safety remains our top priority. By embracing these guidelines, you can maximize your travel experience, ensuring it is both enjoyable and safe.

When in need of filing a Complaint or Claims: If you encounter any issues or have questions during your trip, please promptly notify either us, your host, or your guide. This will allow us to address and resolve any concerns as quickly as possible. Upon the completion of your trip, if you wish to make a claim, submit a complaint, or request reimbursement for any reason, you are required to do so via email within 30 days of the trip's conclusion. Your email must include all relevant supporting documentation related to your claim or complaint. Please be aware that any claims or complaints received after this 30-day period will not be accepted or reviewed.

To submit your claim, complaint, or reimbursement request, please send all necessary information to us at info@lacasitadelturista.com. We will review your submission and get back to you as soon as possible.

Governing Law: The construction, validity, and performance of these Terms and any disputes between the parties shall be governed by and construed according to the laws of Costa Rica, without giving effect to its conflict of law principles, and any federal laws applicable therein. Both parties submit to the exclusive jurisdiction of the courts of Cartago, Costa Rica with respect to any legal proceedings relating to these Terms.

Disputes Resolution: If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting La Casita del Turista S.R.L through email. 


Changes to These Terms and Conditions: We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If we make changes to any of these Terms, we will post the amended terms and conditions on the website, applications, or services, which are effective upon posting. The applicable Terms that apply are those in effect at the time you make a booking with us.

 

Merger Clause:

This Agreement constitutes the final, complete, and exclusive expression of the parties' agreement concerning the subject matter contained herein. It supersedes and replaces all prior and contemporaneous negotiations, representations, discussions, understandings, and agreements, whether oral or written, related to the matters addressed in this Agreement. No additional terms or modifications to this Agreement shall be valid unless made in writing and signed by both parties. By entering into this Agreement, each party acknowledges that they have not relied on any prior statements or promises not expressly set forth in this document.
